Those who stole the sheep from the wealthy farmer may also have stolen from the poor, the poor from each other. Both may have ended up on the gallows together with those who engaged in neither. The historian researching the period and trying to distinguish social and ordinary crime finds it increasingly less possible to sustain any tidy notion of a distinction between these two kinds of crime.

Their view that the concept of crime itself should be extended to embrace all human rights violations is paralleled by the more recent argument of Henry and Milovanovic (1996) who wish to define crime as ‘the expression of some agency’s energy to make a difference on others and it is the exclusion of those others who in the instant are rendered powerless to maintain or express their humanity’ (1996: 116).
